An Introduction to the Madrid Protocol
The accession of the United States to the Madrid Protocol provides U.S. trademark professionals with a streamlined mechanism by which trademark applications can be submitted internationally. Through the Madrid Protocol, it is possible to seek registration on the International Register, and by extension to seek trademark protection in any of the Protocol's member countries.

The International Register is comprised of registrations through both the Madrid Protocol and the previously existing Madrid Agreement, collectively referred to as the Madrid System. Countries may accede to the Protocol, the Agreement or to both. Because the United States has acceded only to the Protocol, U.S.-based trademark applications may only be extended to other countries that are also members of the Protocol. Similarly, only applications based in jurisdictions party to the Protocol may request the extension of trademark protection into the U.S. through the Protocol.

While the Madrid Protocol promises to make international trademark applications more accessible from within the U.S., it also provides a mechanism by which applications seeking U.S. federal registration may be filed from outside the U.S., either as new applications or by seeking "extension" of an existing non-U.S. trademark registration into the United States.
